Terms of Service

Billing Policy

SumNet.tv services are billed on the first of the month, in advance of usage, similar to other utilities. Payments are due by the 10th of that month, and considered late after the 15th of the month. A late fee may be imposed after the 15th of the month. Access charges begin on the day the account is opened -- when a member picks a username and password -- NOT when first used. In the event that computer problems prevent a member from using the account, it is the member's responsibility to notify the billing department and request suspension or cancellation of the account. SumNet.tv accounts are billed at a flat rate for unlimited. Accounts will continue to be billed, whether used or not, until the member cancels the account. SumNet.tv reserves the right to suspend or terminate accounts at any time.

Account Cancellation

A written cancellation request containing member's name, username or e-mail address, and signature is required. The purpose of this document is to ensure that the cancellation request is being made by the owner of the account and that the person presenting it is entitled to request the cancellation. Members may terminate their accounts at any time, however, no refunds will be made for unused services. We do not prorate the final month of service, and all cancellations are effective at the end of the month that the written cancellation is received. Cancellation requests may be faxed, mailed, or delivered to the office. SumNet.tv cannot accept cancellation by phone, or via e-mail due to the ease of forging e-mail headers. If the member account is not delinquent at the time of cancellation, SumNet.tv will, upon request, provide e-mail forwarding for a period not to exceed sixty (60) days.

Account Requirements

(a.) SumNet.tv does not provide service directly to minors. The difficulty in recovering losses from delinquent minor accounts precludes SumNet.tv from offering service to individuals less than eighteen (18) years of age. If a minor requires Internet access, it is recommended that the parents or guardians of the minor set up an account with SumNet.tv. In no way are minors restricted from using our service, they simply cannot be the account holder. SumNet.tv recommends that parents use caution, and supervise their children while they surf the 'net.
(b.) SumNet.tv chooses to not provide access to anonymous individuals. We must have the true and correct name of all subscribers when they sign up for service.

SumNet.tv also requires that all members either pay for services with a major credit card, or if electing to pay by cash or check, to present a valid Driver's License, Military Identification Card, State-Issued Identification Card, or Passport. Use of nicknames or other "handles" while on the Internet is in no way restricted. SumNet.tv requires positive identification of our members for the sole reason to protect the company and its services from the risks of doing business with unknown individuals.

Customer Records

SumNet.tv maintains comprehensive customer records. These records contain billing information, home addresses, phone numbers, usernames and e-mail addresses. This information is required so that we may properly invoice our members. SumNet.tv stores this information securely, both on paper, and on a computer that is separate from our SumNet.tv servers. This information is protected from intrusion or theft. SumNet.tv considers this information highly confidential, and under no circumstances do we sell or freely divulge this material

Responsibility for Content

SumNet.tv does not exercise any control over the content that members may access via our systems. Members are expected to take responsibility for their actions on our system or on systems accessed through SumNet.tv. Members are expected to abide by all posted Usage Agreements on systems they access through SumNet.tv. If a member accesses material that they find offensive, they are expected to avoid the offensive material. Members are expected to take full responsibility for statements made in e-mail, chat rooms, USENET postings, and web pages. We reserve the right to suspend account usage at any time. SumNet.tv is not responsible for the accuracy or validity of any information received through the service. This includes copyrighted material, material judged legally to be obscene or threatening, or material protected by trade secret. The advertisement for, distribution of, or trading of illegally copied software (wares) is expressly prohibited.

Unauthorized Usage

Any unauthorized attempt to access systems or records, or to modify system information, whether on SumNet.tv systems or another system, will result in the suspension of member access. Unauthorized activities include: using passwords other than those assigned to you, guessing at passwords, accessing private information, accessing any system to which the member is not welcome. Sumnet.tv fully prosecutes any unauthorized usage or theft of services.

Unsolicited Commercial Email (UCE) or "SPAM"

SumNet.tv has a "Zero Tolerance" policy regarding SPAM or Bulk E-mail. SumNet.tv considers Unsolicited Commercial Email (UCE) /Bulk E-mail, as well as Excessive Cross-Posting (ECP) to newsgroups, to be detrimental to the Internet community in general and damaging to SumNet.tv systems in particular. Unlike traditional (postal-mail) bulk mailings, where the primary cost of distribution is borne by the sender, Unsolicited Commercial Email (UCE) /Bulk E-mail puts the burden of cost on the recipient. This will remain true as long as it remains free to send an e-mail message.
SumNet.tv strives to remain a responsible 'Net citizen, and as such we will act swiftly and decisively to prevent Unsolicited Commercial Email (UCE) /Bulk E-mail from originating from our server. Many people do not realize what can happen if an ISP allows Unsolicited Commercial Email (UCE) /Bulk E-mail to originate from their servers. Many ISPs and domains block ALL mail from servers that are notorious for allowing Unsolicited Commercial Email (UCE) /Bulk E-mail to originate there. If this happens, none of the mail sent from SumNet.tv to that blocked server can get through. This results in an unsatisfactory condition for the rest of our customers. Since the actions of one or two members can have a negative impact on the service for all of our members, we have chosen to take an aggressive stance against 'spam'.
SumNet.tv members who use any of our services to send unsolicited e-mail are subject to immediate account cancellation, and will be billed $.05/per message, or $1000.00, whichever is greater. This charge is not negotiable and will be applied retroactively if evidence of Unsolicited Commercial or Bulk Mail is discovered. SumNet.tv will pursue any legal action necessary to collect this payment.
Non-members who use SumNet.tv services to send e-mail will be criminally prosecuted. Theft of service of this type is considered "Larceny by False Pretense" and is a felony.

Suspension or Termination of Service

This Terms of Service permits SumNet.tv to terminate a member's account at any time, without notification, and for any reason. If an issue of any means that is not covered in this Terms of Service occurs, SumNet.tv reserves the right to act as needed to protect our systems, data integrity, and SumNet.tv’s reputation. Examples of why access may be terminated: if an account is sufficiently past due and considered delinquent; if we believe there is an attempt to penetrate SumNet.tv system security; if an account is consuming excessive system resources; if the account is 'spamming' mail accounts or news servers.

Data Backup

SumNet.tv produces periodic backup copies of all SumNet.tv data. This data can be used to restore our systems in case of a system failure, damage, or disaster. SumNet.tv does not provide back-up services for member data, including web pages, co-located servers, or any other data or information stored on SumNet.tv servers. The member is responsible for ensuring proper back up of member data, and that plan should not include SumNet.tv support or involvement. Members are cautioned that if they do not provide adequate back-up protection for their data, SumNet.tv does not guarantee data recovery in case of damage or loss of Data.

Agreement to Abide by Terms of Service

Usage of any SumNet.tv service constitutes agreement to adhere to these stated Terms of Service. SumNet.tv reserves the right to modify services or rates for service, Terms of Service, or any other policy.
